These Terms & Conditions apply to every offer made by Mountain Caviar and to every distance contract concluded between Mountain Caviar and the consumer.
Before a distance contract is concluded, the text of these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where the Terms & Conditions can be viewed electronically and that they will be provided free of charge upon request.
If the contract is concluded electronically, these Terms & Conditions will be provided in a manner allowing the consumer to store them on a durable medium.
In addition to these Terms & Conditions, specific product or service conditions may apply. In case of conflict, the most favorable provision for the consumer shall prevail.
By placing an order or otherwise entering into a contract with Mountain Caviar, the consumer unconditionally accepts these Terms & Conditions.
If an offer has a limited validity period or is subject to conditions, this will be clearly stated.
The offer includes a complete and accurate description of the products and/or services offered. Obvious mistakes or errors do not bind Mountain Caviar.
The offer provides clear information regarding:
The total price including VAT;
Any applicable shipping fees;
The steps required to conclude the contract;
Whether the right of withdrawal applies;
Payment, delivery, and execution terms;
The validity period of the offer or price guarantee;
How the consumer can check and correct submitted data;
Applicable codes of conduct and how to access them;
The minimum duration of any long-term transaction.
The agreement is concluded at the moment the consumer accepts the offer and meets the stated conditions.
When acceptance occurs electronically, Mountain Caviar will confirm receipt of the order as soon as possible. Until this confirmation is issued, the consumer may cancel the order.
Mountain Caviar shall take appropriate technical and organizational measures to secure electronic data transfer and ensure a safe online environment.
Mountain Caviar reserves the right to assess, within legal limits, whether the consumer can meet their payment obligations or whether other circumstances justify refusal of the order. If there is reason for refusal, Mountain Caviar may reject the order or impose special conditions.
Upon delivery, Mountain Caviar will provide the consumer with:
The physical address for submitting complaints;
Instructions on exercising the right of withdrawal (or a clear statement if this right is excluded);
Warranty and after-sales service information;
The information required under Article 4, unless previously provided;
The conditions for terminating long-term contracts, if applicable.
For long-term transactions, the information listed in paragraph 5 applies only to the first delivery.
When purchasing products, the consumer has the right to withdraw from the contract within 14 days without providing any reason. The cooling-off period begins the day the consumer or an authorized third party receives the product.
During the cooling-off period, the consumer must handle the product and packaging with care and may only inspect it to the extent necessary to determine whether they wish to keep it.
If the consumer exercises the right of withdrawal, the product must be returned—including all accessories and, where reasonably possible, in its original condition and packaging—according to the return instructions provided by Mountain Caviar.
All prices are stated in euros and include VAT in accordance with Belgian law.
Any applicable shipping fees are clearly communicated before checkout.
Payment must be made using the payment methods offered at the time of order.
Mountain Caviar reserves the right to suspend or cancel an order if payment is refused or not completed on time.
Delivery occurs at the address provided by the consumer during checkout.
Mountain Caviar aims to deliver within the indicated time frame; however, delays do not entitle the consumer to compensation.
The risk of loss or damage transfers to the consumer when the product is physically received by the consumer or an authorized third party.
If delivery becomes impossible, Mountain Caviar may cancel the contract and refund any amounts already paid.
Mountain Caviar guarantees that products comply with applicable Belgian legal conformity standards.
The statutory warranty period for consumers is two years.
Warranty does not apply if defects arise from misuse, improper storage, or failure to follow product instructions. Nor does it apply to supplement other consumable products.
For dietary supplements, the consumer must use the product responsibly and according to recommended dosages.
Complaints must be submitted in writing within a reasonable time to hello@mountaincaviar.com
Mountain Caviar aims to respond to complaints within 14 days.
If a complaint cannot be resolved through mutual agreement, the consumer may submit the dispute to the European Online Dispute Resolution (ODR) platform.
These Terms & Conditions and all agreements between Mountain Caviar and the consumer are governed exclusively by Belgian law.
Disputes shall be submitted to the competent court of the district where REJO NV is established, unless mandatory consumer law provides otherwise.
If any provision of these Terms & Conditions is held invalid, the remaining provisions shall remain fully effective.
